About the RaceTeams Copyright & DMCA Policy

RaceTeams, LLC ("RaceTeams," "we," "us," or "our") respects copyrights, trademarks, publicity rights, and other intellectual-property rights. RaceTeams also operates a marketplace that allows Users to publish Listings, profiles, photographs, videos, logos, reviews, descriptions, sponsorship materials, and other User Content.

Users are responsible for making sure they have the rights and permissions necessary to post, sell, advertise, license, display, or otherwise use the content and intellectual property they submit through RaceTeams.com (the "Service").

This Copyright & DMCA Policy explains how rights holders may report suspected infringement and how RaceTeams may respond. It should be read together with the RaceTeams Terms of Service, Community & User Content Standards, Listing Standards & Prohibited Items Policy, and other applicable RaceTeams policies.

RaceTeams does not obtain ownership of a User's copyright merely because the User uploads content to the Service. The User Content license granted to RaceTeams is governed by the Terms of Service.

By posting User Content, a User represents that the User owns the content or has the licenses, releases, consents, and other permissions needed for the content and for RaceTeams' permitted use of it.

This responsibility includes rights involving:

  • Photographs and video
  • Written copy and articles
  • Artwork, illustrations, graphics, and designs
  • Music and audio
  • Race broadcasts and clips
  • Team, driver, track, series, event, and manufacturer content
  • Sponsor and brand assets
  • Merchandise designs
  • Historical and archival materials
  • Logos and trademarks
  • Names and likenesses
  • Content involving minors
  • Other copyrighted or protected material

Buying an item, possessing a photograph, appearing in an image, sponsoring a race team, or finding content online does not necessarily give a User the right to reproduce, distribute, sell, license, upload, or commercially use that content.

If you are a copyright owner or are authorized to act for one and believe content on RaceTeams infringes your copyright, you may send RaceTeams a written copyright complaint.

RaceTeams intends to process qualifying copyright complaints in a manner consistent with the notice-and-takedown framework of the U.S. Digital Millennium Copyright Act ("DMCA") where applicable. RaceTeams may also respond to copyright complaints that do not qualify as statutory DMCA notices when RaceTeams reasonably believes action is appropriate under its Terms, policies, or applicable law.

A statutory DMCA designated-agent registration requires additional information and registration with the U.S. Copyright Office. RaceTeams will identify its registered DMCA designated agent on this page when that registration is active. Until then, the contact above accepts copyright and intellectual-property complaints, but RaceTeams does not represent through this page that every statutory condition for a DMCA safe harbor has been completed.

To help RaceTeams evaluate a copyright complaint, provide a written notice containing substantially the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  2. Identification of the copyrighted work claimed to have been infringed. If multiple copyrighted works are involved, a representative list may be provided where legally appropriate.
  3. Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient for RaceTeams to locate it. Specific RaceTeams URLs, Listing URLs, profile URLs, screenshots, or other precise location information are strongly encouraged.
  4. Information reasonably sufficient for RaceTeams to contact the complaining party, including name, mailing address, telephone number, and email address.
  5. A statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, the owner's agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is the copyright owner or is authorized to act on behalf of the owner.

RaceTeams may request additional information when reasonably necessary to identify the work, locate the material, confirm authority, understand the claim, or process the complaint.

Do not submit a copyright complaint merely because you dislike a Listing, disagree with a User, object to criticism, or believe a competing Seller should not be allowed to use lawfully obtained material. Copyright complaints must be submitted accurately and in good faith.

4. What RaceTeams may do after receiving a complaint

Depending on the complaint and circumstances, RaceTeams may:

  • Request additional information
  • Preserve relevant records
  • Remove or disable access to content
  • Temporarily restrict a Listing or Account
  • Notify the User who posted the material
  • Forward the complaint or relevant portions of it to the affected User
  • Request evidence of ownership, permission, licensing, fair use, or another lawful basis
  • Restore material when appropriate
  • Restrict or terminate repeat infringers
  • Report suspected fraud, forgery, or unlawful conduct where appropriate
  • Decline action when the complaint is incomplete, unsupported, misdirected, or does not establish a reasonable basis for action

Removal of material does not mean RaceTeams has made a final legal determination that copyright infringement occurred. Likewise, declining to remove material is not a legal determination that the content is noninfringing.

RaceTeams is not a court and does not adjudicate ownership disputes between Users or rights holders.

5. Counter-notification

If RaceTeams removes or disables material in response to a copyright complaint and the affected User believes the material was removed because of mistake or misidentification, the User may submit a written counter-notification.

For a counter-notification intended to qualify under the DMCA, it should contain substantially the following:

  1. The User's physical or electronic signature.
  2. Identification of the material that was removed or disabled and the location at which it appeared before removal or disabling.
  3. A statement under penalty of perjury that the User has a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. The User's name, address, and telephone number.
  5. A statement that the User consents to the jurisdiction of the appropriate United States federal district court for the judicial district in which the User's address is located, or, if the User is outside the United States, for a judicial district in which RaceTeams may be found.
  6. A statement that the User will accept service of process from the person who submitted the original copyright notice or that person's agent.

Send counter-notifications to the copyright contact identified above or to any subsequently published registered DMCA designated agent.

RaceTeams may forward a qualifying counter-notification to the person who submitted the original notice.

Where the statutory DMCA counter-notification process applies, RaceTeams may restore the affected material not less than 10 and not more than 14 business days after receipt of a qualifying counter-notification unless RaceTeams first receives notice that the complaining party has filed an action seeking a court order to restrain the allegedly infringing activity or another lawful basis prevents restoration.

RaceTeams may keep material removed for an independent violation of its Terms, Community & User Content Standards, Listing Standards & Prohibited Items Policy, or applicable law even if a copyright counter-notification is submitted.

6. Repeat infringers

RaceTeams maintains a policy of restricting or terminating, in appropriate circumstances, Users who repeatedly infringe copyrights or other intellectual-property rights.

RaceTeams may consider factors such as:

  • The number and nature of substantiated complaints
  • Repeated reposting of material after removal
  • Evidence of counterfeit or unauthorized merchandise
  • Attempts to evade enforcement through new Accounts or Listings
  • Good-faith mistakes versus knowing or repeated misconduct
  • Counter-notifications and subsequent legal proceedings
  • Other relevant facts and legal requirements

A single complaint does not automatically make a User a repeat infringer, and RaceTeams may evaluate the circumstances before taking Account-level action.

7. Misrepresentations and abuse of the complaint process

Copyright notices and counter-notifications are legal communications. A person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled through mistake or misidentification, may face liability under applicable law.

Users may not misuse the RaceTeams reporting process to:

  • Harass or intimidate another User
  • Suppress lawful competition
  • Remove criticism or an unfavorable review merely because it is unfavorable
  • Falsely claim ownership of another person's work
  • Interfere with a lawful resale of authentic property without a valid intellectual-property basis
  • Submit forged documents or signatures
  • Repeatedly file complaints known to be false or materially misleading

Abuse of the reporting process may result in Account restrictions or other action under RaceTeams policies.

8. Trademark, counterfeit, publicity, and other intellectual-property complaints

The DMCA notice-and-counter-notice procedure applies to copyright claims. Trademark, counterfeit, right-of-publicity, and other intellectual-property complaints may involve different laws and procedures.

A rights holder reporting another type of intellectual-property concern should provide:

  • The rights holder's identity and contact information
  • The protected mark, work, name, likeness, or other right
  • Registration information where applicable
  • The specific RaceTeams content at issue
  • The Listing or profile URL
  • A description of the claimed violation
  • The relationship of the complaining party to the protected right
  • Supporting records reasonably available
  • A good-faith statement that the complaint is accurate

RaceTeams may request additional information and may restrict or remove content when reasonably appropriate under the Terms, Listing Standards & Prohibited Items Policy, Community & User Content Standards, or applicable law.

9. Merchandise, memorabilia, photographs, and racing marks

Motorsports commerce frequently involves intellectual-property rights belonging to multiple parties.

For example, a race-used item may be genuine while photographs used to advertise it are copyrighted by someone else. A Seller may own a race car but not own every team, sponsor, series, driver, manufacturer, or event mark appearing on it. An autograph may be authentic while a reproduction of a licensed photograph or trading card is unauthorized. A team may control some sponsorship inventory but not rights owned by a series, track, broadcaster, manufacturer, or another sponsor.

Sellers must independently confirm their authority to use protected material and may not rely on RaceTeams to determine licensing ownership or clearance.

10. RaceTeams trademarks and content

RaceTeams.com, RaceTeams, RaceTeams logos, design elements, original website copy, software, marketplace architecture, graphics, and other RaceTeams-owned materials may be protected by copyright, trademark, trade-dress, database, contract, or other laws.

Except as allowed by the Terms of Service, the Service, or written permission from RaceTeams, Users may not copy, scrape, reproduce, republish, sell, license, frame, mirror, create a confusingly similar service from, or use RaceTeams intellectual property in a manner that falsely implies affiliation, sponsorship, endorsement, or authorization.

Nothing on RaceTeams transfers ownership of a third party's trademark, copyright, racing mark, photograph, likeness, or other protected right to RaceTeams or to another User.

11. Preservation and disclosure of records

RaceTeams may preserve complaints, counter-notifications, User communications, Listing versions, Account records, and related evidence when reasonably necessary for enforcement, fraud prevention, dispute handling, legal compliance, or protection of rights.

RaceTeams may disclose information as described in the Privacy Policy, including when required by law, legal process, a valid subpoena, or another lawful request.

12. Changes to this Policy

RaceTeams may update this Policy prospectively as the Service, law, Copyright Office procedures, and marketplace risks change. The current version will be posted through the Service with an updated "Last Updated" date.
